Examining my own views further, the best argument I can think of is that for the death penalty to be truly unbiased as a whole, it would have to not even be an option. But also him not being executed would just pile on to the unfair nature of a biased system, as executions continue to be carried out on people that actually didn't get fair trials or investigations.
